OPINION

By HURD, J:

The petitioner, Dr. Daniel P. Roberto, a practicing physician in the City of Cleveland, has invoked the original jurisdiction of this court for the purpose oí obtaining a writ of Habeas Corpus to release him from technical arrest on a mittimus issued for contempt of a notary public because of his refusal to answer certain questions propounded to him during the course of a hearing by way of deposition in two cases now pending in the Court of Common Pleas of Cuyahoga County.
