In this diversity action plaintiff Medical Development Corporation sued for damages and other relief claiming breach of contract and warranty, negligence, fraud, and other wrongs. Defendant Industrial Molding Corporation counterclaimed for unpaid balances of goods sold and other relief including a stay of the proceedings pending arbitration. Plaintiff’s motion for summary judgment was denied, and its appeal from this order is No. 72-1505. On plaintiff’s motion, the court permanently enjoined arbitration of certain disputes.
