SAND, Justice.

Richard Collins appealed from an order denying his motion for a judgment notwithstanding the verdict or, in the alternative, for a new trial.

In the fall of 1979 Willis Wright, of Salt Lake City, Utah, informed Richard Collins and his brother, Douglas Collins, of the opportunity to purchase a franchise for a trade and barter organization in western North Dakota.
