MEMORANDUM OPINION AND ORDER

STARRETT, District Judge.

This matter is before the Court on Motion for Judgment on the Pleadings filed on behalf of Radiator Specialty Company (hereinafter “RSC”), pursuant to Rule 12(c), Federal Rules of Civil Procedure and on a separate Motion to Dismiss pursuant to Rule 12(b)(6) filed on behalf of United States Steel (hereinafter “USS”).
