OPINION & ORDER
FORESTER, Chief Judge.
This matter is before the Court upon the following motions: plaintiffs’ motion for a preliminary injunction [DE #2] and defendants’ motion for summary judgment [DE # 6]. These motions are ripe for review. The Court heard oral argument on the above motions August 22, 2002, at which time the parties were given the opportunity to present testimony.
