delivered tbe opinion of tbe Court.

Tbe plaintiff Wise sued tbe defendant City of Knoxville for back salary in tbe amount of $11,045.32. Tbe Circuit Judge allowed a recovery for this amount less $7,061.59, tbe amount the plaintiff earned during bis suspension, and tbe lower court entered a judgment in favor of tbe plaintiff for tbe sum of $3,987.73. Tbe plaintiff alone has appealed.

Tbe plaintiff was a policeman in tbe City of Knoxville. In March, 1948 be was suspended and later discharged from bis position because of having been charged with a felony.
