CALVERT, Chief Justice.

The judgment rendered herein on February 14, 1962, is set aside and the judgment of the Court of Civil Appeals is affirmed. The opinions heretofore filed herein are withdrawn and the following is now filed as the opinion of the court.

This is a declaratory judgment suit.

Petitioner is a governmental agency created by the Legislature pursuant to authority contained in Section 59 of Article 16 of the Constitution of Texas, Vernon’s Ann.St. See Art. 8280-119, Vernon’s Annotated Texas Civil Statutes.
