Once more a panel of this Circuit confronts the continuing saga of EEOC v. D.H. Holmes Co., Ltd. (a.k.a. Neidhardt v. D.H. Holmes Co., Ltd.). In the last installment, which was unpublished, a panel assessed appellate costs and attorneys’ fees against three individual intervenors-appellants because they brought a frivolous appeal of the district court’s decision on the merits. On remand for a determination of these costs, D.H. Holmes Co., Ltd. (“Holmes”) also explicitly requested, for the first time since judgment was entered, attorneys’ fees for previous district court…
