Following entry of a consent decree between the Equal Employment Opportunity Commission (EEOC) and Commonwealth Oil Refining Company, Inc. (Commonwealth) (settling EEOC charges of hiring and promotion discrimination against women and Puerto Ricans at Commonwealth’s Peneulas, Puerto Rico, facilities), Commonwealth filed suit in federal district court for attorney’s fees under § 706(k) of Title VII, 42 U.S.C. § 2000e-5(k) (1976), asserting that it was the prevailing party and that the EEOC’s suit was brought in bad faith.
