OPINION
RODRIGUEZ, District Judge.
This matter is before the Court on Plaintiffs motion for summary judgment and Defendant’s cross-motion for summary judgment. For the reasons set forth below, Plaintiffs motion will be granted.
BACKGROUND
The following facts are undisputed by the parties. Plaintiff Theresa G. Mas-troianni (“Mastroianni”) began her career as a self-employed certified shorthand court reporter in 1976.
