Appellant was indicted for the crime of murder in the first degree, alleged to have been committed by shooting and killing one Henry Y. Browne, and, upon his trial, was convicted of involuntary manslaughter and given a sentence of one year in the penitentiary.
It is insisted that the verdict is contrary to the undisputed evidence, and that there was no testimony warranting the submission of the question of involuntary manslaughter.
