Appellant, Buck Outler, was convicted of the crime of murder in the first degree, alleged to have been committed on December 24, 1921, in Montgomery County, by striking with a gun and killing Will Blackburn. The jury fixed appellant’s punishment at' imprisonment in the penitentiary for life, and, upon the overruling of appellant’s motion for a new trial, the court granted an appeal to this court.
