MEMORANDUM OPINION

THIS MATTER is before the Court on Motion for Summary Judgment filed by Defendant United Corporation d/b/a Plaza Extra. For *61the reasons stated below, summary judgment will be granted in part and denied in part.
I. BACKGROUND
