STATEMENT OF THE CASE

The National Railroad Passenger Association ("Amtrak") brings this permissive interlocutory appeal from the trial court's order denying Amtrak's motion for judgment on the pleadings. Robert C. Everton was served alcoholic beverages while a passenger on an Amtrak train. Amtrak employees later found Everton unconscious, and after removing him from the train and delivering him into the custody of law enforcement officers in Crawfordsville, Everton was severely injured in the Montgomery County jail when he attempted to stand but fell.
