— Affirming.
On tiie 5th day of March, 1917', the Commonwealth’s attorney, in whose district the county of McLean is situated, instituted this penal action, in the name of the Commonwealth of Kentucky, against the appellant, Southern Express Company, and sought to recover a judgment against it for a fine of two hundred dollars, for a violation of subsection 2, of section 2569b, Kentucky Statutes.
