*526In an action to recover damages for personal injuries, the plaintiff appeals from a judgment of the Supreme Court, Kings County (Harkavy, J.), dated January 5, 2005, which, upon the denial of her application, in effect, for a continuance of the trial, is in favor of the defendant and against her dismissing the complaint.

Ordered that the judgment is reversed, on the facts and as a matter of discretion, without costs or disbursements, the complaint is reinstated, and the matter is remitted to the Supreme Court, Kings County, for a new trial.
