Introduction

Plaintiff Pettibone Corporation and its related companies (collectively “Pettibone”) successfully reorganized in Chapter 11. Plaintiff filed a two-count Adversary Complaint seeking declaratory and injunctive relief to bar Defendant Barbara J. Payne (“Payne”) from pursuing her personal injury suit against Pettibone.
