This appeal is by Edgar Lapierre from judgment of conviction and order denying his motion for a new trial. Appellant and one Leo Archambault are brothers-in-law, Gabrielle Lapierre, the wife of appellant, being the sister of Archambault. These three persons were jointly charged on the thirteenth day of January, 1928, in the superior court of Alameda County by the district attorney with the crime of murder, alleged to have been committed on January 3, 1928, in the unlawful taking of the life of William J. Davis, a police officer of the city of Oakland. All three defendants were tried together…
