These consolidated actions for personal injuries and property damages grew out of an automobile acqident which occurred on U. S. Highway 70, at a point ten miles west of Cookeville, Tennessee, about midnight on November 13, 1951, when a Chevrolet car owned and driven by the defendant, L. S. White, collided with a Pontiac automobile owned by Henry W. Mcllwaine, one of the plaintiffs, and driven by James E. Seier, the other plaintiff.
