The defendant was found guilty of selling a firearm to a minor in violation of Gr. L. c. 140, § 130, and of carrying a firearm without a license in violation of Gr. L. c. 269, § 10. This appeal, the trial having been made subject to G. L. c. 278, §§ 33A-33G-, challenges the latter conviction.

There is but one assignment of error and that concerns a ruling on evidence. The ruling occurred in these circumstances. One Melvin Simpson was called as a witness by the defendant. Simpson at that time was in custody and he was brought into court, accompanied by his counsel, pursuant to a writ of habeas…
