KELLEHER, Justice.

This is a statutory petition for certiorari which we issued pursuant to the relevant provisions of the Administrative Procedures Act (APA), to wit, G.L.1956 (1977 Reenactment) § 42-35-16, at the behest of the Director of the Department of Environmental Management (DEM).
