EDWARDS, Chief Judge:

The National Transportation Safety Board (“NTSB” or “Board”) is an independent federal agency charged with investigating airplane accidents. The agency does not function as a traditional regulatory or adjudicatory body; rather, its principal missions are to determine the probable cause of accidents and make recommendations that will help prevent future accidents.
