The nature of this suit can be best understood from a brief statement of the facts upon which it is based. In a suit for an accounting between the parties to this suit, a decree was entered by the district court of Harris county on March 31, 1917, by which it was adjudged and decreed that appellee herein was indebted to appellant in the sum of $2,534.82, and that appellee was the owner of a one-half interest in a note for $11,861.24, executed by the Keystone Mills Company in favor of appellant and held by him for the joint account of himself and appellee.
