The plaintiffs brought separate suits against defendant Polishuk in this Court for damages for personal injuries resulting from an automobile accident involving a motor vehicle driven by defendant, resting jurisdiction in each case upon diversity of citizenship of the parties.

Defendant filed a motion to dismiss in each case on the ground he was an employee of the United States and was operating the motor vehicle while acting within the scope of his employment and that the exclusive remedy of' plaintiff is by suit against the United States as provided in 28 U.S.C.…
