This is an appeal from a judgment wherein appellant Demes was convicted of murdering Leland Browse and of assault with a deadly weapon with intent to murder Adam Safian.

In an information filed in Los Angeles County on February 18, 1959, the defendants were charged in Count I with violating the provisions of section 187, Penal Code (murder) and in Count II with violating the provisions of section 217, Penal Code (assault with a deadly weapon with intent to commit murder).
