In an action, inter alia, to recover damages for legal malpractice, the defendant appeals from an order of the Supreme Court, Suffolk County (Henry, J.), dated May 19, 2005, which denied his motion pursuant to CPLR 3211 (a) (5) to dismiss the complaint and granted the plaintiffs cross motion for leave to serve an amended complaint adding a cause of action to recover damages for fraud.
Ordered that the order is modified, on the law, by deleting the provision thereof denying those branches of the motion pursuant to CPLR 3211 (a) (5) which were to dismiss the first and second causes of action,…
