I. Introduction

This action is before the Court on Defendant’s Motion for Partial Summary Judgment pursuant to Rule 56 of the Court of Federal Claims (RCFC). Defendant contends that 28 U.S.C. § 1498(c) bars Plaintiff from receiving compensation for the use of methods claimed in U.S. Patent No. Re. 34,-162 (“the ’162 Patent”) in the manufacture of silicon carbide fiber sheet products used by *831the F-22 fighter program because the claim arises in a foreign country.
