Defendant Mackinac Center for Fublic Folicy (Mackinac) appeals by leave granted from the trial court’s order denying its motion for summary disposition of plaintiffs’ claims of invasion of privacy. Flaintiffs alleged that a publication by Mackinac gave rise to both “appropriation” and “false light” claims of invasion of privacy. We conclude that plaintiffs’ appropriation claim must fail because Mackinac’s publication was protected by the First Amendment because its subject matter was a matter of legitimate public concern.
