*202This is an appeal by plaintiff-appellant Brannon from the summary judgment granted defendant-respondent Lewis and Clark County by the district court of the first judicial district on appellant’s suit for damages resulting from alleged trespass and continuing trespass by respondent.

In summary form, the facts of this action are that in 1888 an Addition was laid out on the west end of the City of Helena.
