MEMORANDUM
BLAKE, District Judge.
Now pending before this Court is a motion by Defendant, America Online, Inc. (“AOL”), to dismiss the complaint of Plaintiff Jeffrey A. Koch on the basis of improper venue. On behalf of himself and those similarly situated, Plaintiff Koch has filed a class action complaint against AOL alleging breach of contract, breach of the implied covenant of good faith and fair dealing, and unjust enrichment in connection with contracts by AOL to provide Internet service to Plaintiff and class members.
