This is an action of tort, to recover damages for personal injuries sustained by the plaintiff, as a result of the alleged negligence of the defendant Crowell’s testator. At the close of all the evidence the judge refused to grant a written motion of the defendant to direct a verdict in her favor and also refused to give certain requests made by her for instructions to the jury in form or in substance.
