On February 5, 1974, the defendant was indicted on charges of unlawful possession of a Class B controlled substance (amphetamines) (Indictment No. 80203), unlawful possession of hypodermic needles and syringes (Indictment No. 80204), and, together with Tina Cohen and Hem Dep Chin, conspiracy to possess with the intent to distribute heroin (Indictment No. 80205). On May 14, 1975, the defendant was convicted by a jury on Indictments No. 80203 and 80204.
