In an action to recover damages for personal injuries, the defendant appeals from an order of the Supreme Court, Kings County (Bernstein, J.), dated July 11, 1990, which denied its cross motion for leave to amend its answer to assert the affirmative defense of release and for summary judgment, and which ordered the matter restored to the trial calendar.
