HENDERSON, Circuit Judge:

Lance Eisenberg appeals from the refusal of the United States District Court for the Southern District of Florida to reconsider its order vacating his permission to depose an alleged government informant.

In June, 1979, Eisenberg filed a petition pursuant to Rule 27 of the Federal Rules of Civil Procedure seeking leave to depose in anticipation of litigation. 1 The subject of the deposition was to be Kenneth Guilbert, an agent of Scotland Yard assigned to the Cayman Islands, who was believed by Eisenberg to have been conducting surveillance of him at the request of the…
