The United States of America brought suit against New Castle County (“County”), William C. Ward and Stauffer Chemical Company (“Stauffer”) seeking an injunction under section 7003 of the Resource Conservation and Recovery Act (“RCRA”), 42 U.S.C. § 6973 (1976) (as amended). The complaint was amended to add a claim under section 106 of the Comprehensive Environmental Response, Compensation and Liability Act of 1980 (“CERCLA”), 42 U.S.C. § 9606(a) (1980).
