Sloan, J.:

This was an action to recover damages for the wrongful death of a person. The plaintiffs prevailed, and the defendant appeals.

The defendant operates a street-car system in the city of Pitts-burg, which extends north of the city limits on the public highway for a distance of approximately one-half mile. The street-car track is in the middle of the public highway, and on either side of the track there is a brick pavement sixteen feet wide.
