Plaintiff in error Bernard C. Poppe, defendant in the district court for Sarpy County, brings this error proceeding seeking reversal of his conviction of unlawfully operating a motor vehicle upon the public highways of this state while under the influence of alcoholic liquor. The information also contained charges of two previous convictions of a like offense. His motion for new trial having been overruled, the defendant was sentenced to serve not less than 1 year nor more than 18 months in the State Reformatory for men.
