ORDER
BENSON, Chief Judge.
The above entitled action arises out of an incident that occurred on May 16, 1978, wherein the plaintiff’s decedent, while riding as a passenger in a boat on Leech Lake, Cass County, Minnesota, was killed when the boat went out of control, spilling the occupants into the lake. The boat was owned by the University of North Dakota and operated by Lewis Oring, an employee of the University.
