1. It appears from the record that James M. Huff died in 1890, leaving a will. Specific legacies were bequeathed to four persons named. B. W. Huff was appointed executor, and qualified as such. The will was offered for probate, when it seems a caveat was filed by heirs of the testator. The will was, however, admitted to record, and an appeal was taken to the superior court. In that court the appeal was, by some means, converted into an equitable proceeding, and an alleged consent verdict and decree were had by which it was provided that the will be set aside; that the land be sold; that out…
