Prior to the initiation of reorganization proceedings under section 77B of the Bankruptcy Act, as amended (11 U.S.C.A. § 207), on April 24, 1930, suit had been instituted in the state court for foreclosure of a trust deed upon the property involved. Directly after the initiation of that proceedings, the court appointed appellant receiver, as provided by the trust deed, and it continued as such thereafter.
