CRABB, District Judge.
This is a civil action for injunctive and monetary relief in which plaintiff Promega Corporation alleges that defendant Novagen, Inc. infringed its patents for biotechnological inventions relating to protein synthesis. The parties have filed cross-motions for summary judgment on the validity, enforceability and infringement of the two patents held by plaintiff, United States Patents Nos. 5,324,-637 (’637) and 5,492,817 (’817).
