MEMORANDUM OF DECISION
BENSON, Chief Judge. .
Plaintiff brought this action for damages resulting from an automobile accident. The Attorney General for the State of North Dakota, representing the North Dakota Unsatisfied Judgment Fund, has moved in behalf of the Defendant, to dismiss the action. 1
The facts relevant to a determination of the issues raised by the Defendant’s motion are not in dispute. The Plaintiff and Defendant are Indians, and are both enrolled members of the Devils Lake Sioux Tribe, located on the Fort Totten Indian Reservation in North Dakota. The accident occurred within the…
