Appeal by the defendant, the Union Bailway Company of Hew York City, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Hew York on the 18th day of December, 1907, upon the verdict of a jury for $750, and also from an order entered in said clerk’s office on the 9th day of March, 1908, denying the defendant’s motion for a new trial made upon the minutes.

Adhering to the views expressed by me in Douglas v. Met. St. R. Co. (119 App. Div. 203) I concur in result.
Laughlin, J., concurred with Clarice, J.; Scott, J., dissented.
Judgment and order reversed, with costs to abide event, unless plaintiff stipulates as indicated in opinion, in which event judgment as modified, and order affirmed, without costs. Settle order on notice.
