HIGGINS, Judge.
Plaintiffs instituted this action ex delicto against the insurance carrier of the New Orleans city park improvement association, under Act No. 55 of 1930, for damages for the death of their minor son, who was drowned in the city park swimming pool, which is maintained and operated by the assured. The defendant filed exceptions of no right or cause of action on the ground that, as the association was exercising governmental functions delegated to it by the state of Louisiana in operating the city park and swimming pool located therein, it is exempt from liability for the torts…
