GARDNER, Chief Judge.

This was an action brought by appellee as plaintiff to recover from appellant damages to its pipeline, alleged to have been caused by the negligent explosion of a charge of dynamite by appellant’s employees. It will be convenient to refer to the parties as they were designated in the trial court.

Defendant’s answer admitted the corporate existence of plaintiff and defendant, admitted diversity of citizenship, admitted that plaintiff was and is engaged in transporting and selling natural gas and that it maintains high pressure gas pipelines in various counties in the State…
