ORDER
Eugene Cherry was ransacking a home when sheriffs deputies interrupted the burglary. He fled but was apprehended an hour later. Cherry was convicted and is in prison, but in this suit under 42 U.S.C. § 1983, he claims that the law-enforcement officers who caught him lacked probable cause to make an arrest and also used excessive force in taking him into custody. The district court granted summary judg ment for the defendants, and Cherry appeals. We affirm the judgment.
