The parties to this action were divorced in the state of Alabama on May 9, 1962. In the divorce decree the petitioner herein, Arthur W. Emmons, was ordered to pay the petitionee, Jean S. Emmons, alimony of $20.00 per week. This alimony was predi cated on an agreement executed by the parties in the state of New York.

Following the divorce Mr. Emmons moved to the state of Vermont and remarried. Fie now resides here. Mrs. Emmons has never been a resident of the state of Vermont.
