In June of 1978, the plaintiff brought an action in the Superior Court against the members of the commission, “as they are the duly constituted License Commission” and against the members of the License Board of Worcester, “as they are the duly constituted License Board.” By its complaint the plaintiff sought to compel the commission to render a decision on its applications for a license to conduct nude dancing at the Blue Max Casino (Casino), a night club located in Worcester; it also sought to enjoin the board from reducing the seating capacity at the Casino from 200 to 20 patrons.
