STATEMENT OF THE CASE
In October 1999, Jennings Northwest Regional Utilities and Vance D. Funkhouser, Max A. Wiley, Norma Teeple, Donald McCauley, Lyon H. Clark, Jolene McQueen, and Paul Michael Irwin, in their capacities as Trustees of Jennings Northwest Regional Utilities (collectively "JNRU"), filed a declaratory judgment action against the City of North Vernon, Indiana ("the City"), asking the trial court to determine that JNRU is authorized to provide sewer services to Sand Creek Elementary School ("the School") and that the City has no right to provide such services.…
