Oliver Beirne, on the 31st of March, 1870, instituted *750a chancery suit in the circuit court of Monroe county, to enforce the specific performance of a contract in writing, dated December 26, 1862, made by E. M. Brown with him, for the purchase of a tract of land of six hundred and fourteen acres, in Monroe county, which, in accordance with the contract, he had put said vendee in possession of shortly after said sale, and upon which Brown had paid only $5,000.00.
